About This Policy
This Refund and Cancellation Policy applies to software development services, website development, mobile applications, AI automation, SaaS development, UI/UX design, integrations, maintenance, and other services provided by Gobeens Technology Private Limited ("Gobeens", "Company", "we", "us", or "our"). This Policy should be read together with the applicable quotation, invoice, and project agreement.
1. General Policy
Software development projects require advance planning, resource allocation, technical work, and coordination between the Company and the client. Payments may cover project initiation, design, development, testing, third-party services, personnel allocation, and other agreed commitments.
Accordingly, payments are not automatically refundable merely because a client changes their mind, cancels a project, delays the project, or decides not to use the delivered work.
Refund eligibility will be assessed in accordance with the applicable contract, the circumstances of the cancellation, and applicable law.
2. Advance Payment
Unless the relevant agreement provides otherwise, the standard project payment schedule is:
| Milestone | Payment |
|---|
| Project confirmation | 30% |
| UI/UX presentation | 10% |
| Backend presentation | 30% |
| Frontend presentation | 20% |
| Complete testing | 10% |
The initial advance confirms the project and enables us to begin agreed preparatory activities and resource allocation. The advance is intended to cover applicable project commitments. Its treatment upon cancellation will depend on the agreement and applicable law.
3. Client-Initiated Cancellation
If a client requests cancellation before or after project completion:
- The client must submit the cancellation request in writing to info@gobeens.com.
- Work on the project may be paused while the request is reviewed.
- Completed milestones, work performed, outstanding invoices, and agreed non-cancellable commitments will be considered in the cancellation settlement.
- Amounts already paid are not automatically refundable.
- Any remaining amount payable will be determined according to the applicable agreement and law.
- A cancellation request does not automatically waive outstanding contractual obligations.
The Company intends to protect payments received for committed project work. However, this Policy does not authorize forfeiture of every payment in every circumstance, regardless of the work performed or applicable legal rights.
4. Cancellation After Project Completion
Once a project has been completed and delivered in accordance with the applicable agreement, the client cannot demand a refund solely because they no longer require the software, change their business strategy, decide not to launch the product, choose another developer, experience a change in budget, or decide not to use the delivered project.
This does not remove any remedy available for a substantiated contractual breach, a qualifying defect, or a statutory right that cannot lawfully be excluded.
5. Instalment Defaults
Each instalment must be paid according to the agreed schedule. A seven-calendar-day grace period applies to each instalment, unless the relevant agreement specifies otherwise.
If payment remains overdue after the grace period, we may issue written notice and suspend affected work until the overdue amount is cleared, subject to the agreement and applicable law. Suspension may affect delivery schedules, testing, deployment, and handover.
6. Source Code and Outstanding Payments
Unless otherwise agreed in writing:
- The Company may retain source code and other handover materials until the full agreed project amount and other due charges have been paid.
- The client will not receive final source-code handover merely because a project has reached a demonstration or testing milestone.
- Any ownership transfer or licence that depends on full payment will take effect according to the applicable written agreement.
- The client may not use, distribute, or commercially exploit unpaid deliverables except where expressly authorized.
These provisions are subject to applicable law and any express contractual rights already granted to the client.
7. Scope Changes and Additional Work
Work requested outside the agreed scope may involve additional charges. If a client cancels after approving additional work, the charges and settlement will be determined by the applicable agreement, the work performed, and the agreed commitments.
8. Third-Party Costs
Third-party subscriptions, hosting charges, domain registrations, licences, API usage, and similar costs may be non-refundable under the relevant provider's terms.
Where such costs have been incurred or committed for a client project, their treatment will depend on the applicable agreement, provider terms, and law. This does not override any legal obligation that applies to the Company itself.
9. Company-Initiated Cancellation
If the Company cannot continue a project, the parties should attempt to agree on a practical resolution. Depending on the circumstances and contract, this may include completing a defined portion of the work, transferring agreed completed deliverables, adjusting the remaining scope, agreeing on a cancellation settlement, or providing a refund where contractually or legally required.
10. Defect Correction
Where a project agreement includes a 15-day defect-reporting period, clients should report qualifying defects in writing within that period. The Company will assess reported defects against the agreed specifications.
A defect-reporting period is not a blanket exclusion of statutory rights and does not automatically determine whether a refund is legally available.
11. Refund Processing
Where a refund is approved or legally required:
- The Company will confirm the applicable settlement.
- The client may be asked to provide transaction details necessary to process the refund.
- Refunds will ordinarily be made through the original payment method where feasible.
- Processing timelines may depend on the payment provider and banking system.
- We will communicate the expected processing timeline once the refund is approved.
12. How to Request Cancellation or a Refund
Send an email to info@gobeens.com with your client/business name, project name or reference number, relevant invoice or transaction details, reason for the request, and supporting documents where applicable.
The Company will review the request and respond within a reasonable period.
